GENERAL INFORMATION

1) This website and domain name www.sweebee.sg are owned and operated by Swee Bee Contractor Pte Ltd, Company Registration No. 198800966Z.

2) In these terms and conditions and the Special Conditions (as defined below) (collectively referred to as the “Terms and Conditions”), "Swee Bee" or “we” or “us” means Swee Bee Contractor Pte Ltd and the "customer" or “you” means any person, firm, company or body which places an order with us. Please read these terms and conditions carefully before using our website. By using our website or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.

3) By using the website, you are agreeing to all of the Terms & Conditions, and together with the Privacy Policy, may be updated by us from time to time without notice.

YOUR ACCOUNT

1) You are advised to register as a user before placing any order through our website:

• You must be 18 years old or above and are capable of entering into a binding contract (in case you are below 18 years old: you must obtain consent from your parent(s) or legal guardian(s), their acceptance of the Terms and Conditions herein and their agreement to take responsibility for (i) your actions and (ii) any charges associated with your purchases at our website.

• You must provide us with accurate, complete and up to date registration information;

• You must safeguard your username and password;

• You authorise us to assume that any person using the website with your username and password is either you or is authorized to act for you;

• You agree to accept responsibility for all activities that occur under your account or password;

• We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever.

2) Please inform us via emails or phone calls immediately of any changes to the information that you provided so that we can communicate with you effectively.

3) In the event that your account is not used for a specified period (currently, 2 years), we will, for your own and our protection, deem your account to be no longer in use, and we will deactivate your account and all your accumulated points and/or e-vouchers will be forfeited (where applicable). You will need to reapply for a new account if you wish to make further purchases at our website.

4) If you are not a registered user of our website, you can still purchase and pay for the order. In such case, you are required to provide an email address for receiving the purchase receipt.

PRIVACY PROTECTION

We are committed to safeguarding the privacy of individuals with respect to personal data. We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data Protection Act 2012 under the laws of Singapore. LIMITATION AND EXCLUSION OF WARRANTIES AND LIABILITIES

1) All efforts have been made to ensure that all details, descriptions, contents, and prices which appear on this Website are accurate. However, errors (including processing errors) may occur.

2) If we discover an error in the price or payment of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.

3) If we are unable to contact you within 24 hours, we reserve the right to cancel your order without prior confirmation from you. 

4) If the order is cancelled and you have already paid for the goods, you will receive a full refund.

5) We will not be liable for any loss or damage of any nature arising out of, or in connection with, the use of this website.

6) Product specifications and prices are subject to change from time to time.

7) No assurance is given that items featured on this website are available now or in the future.

8) Title to the product shall remain vested in us until we receive full payment of the price, and title and risk shall pass to the customer upon collection of the product(s) by our delivery team or by the customer..

9) We shall under no circumstances be liable for any loss (whether direct or indirect) of revenue, loss of profits or any indirect or consequential loss whatsoever suffered, sustained or incurred by you or by other person arising (directly or indirectly) out of the sale and purchase transaction with you.

TERMS OF SALE

1) We shall make every effort to ensure that prices, details and sizes of products at our website are up-to-date. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability.

2) Placing an order means you agree to purchase products or services and appoint us to deliver the same on your behalf to your specified delivery address or for collection in accordance with these Terms and Conditions. After receiving your order, we will acknowledge receipt of your order. However, it is not an acceptance of your order. We reserve the right to reject any order without giving any reasons. In the event that we are unable to accept your order (due to various possible reasons), we will notify you by email and/or via phone calls and/or text messages.

3) All photos and images of the products displayed on our website are for illustration purposes in order to help you recognise the products only. The actual condition, size, dimension and colour of the products may differ as they are live plants and unique in their own way. There will not be never 100% similarity to the photo uploaded on the product page.

4) All measurements are taken to an approximate value.

5) In case any applicable gift items of your purchased products under the order confirmation are not available, you may decide whether to accept another gift item, cancel the

order or continue to purchase the products.

6) The condition of perishable items may be beyond our control. Please buffer about 10% for spoilage. 

7) We have the right, at any time, or from time to time, by giving prior notice to you, to modify or vary or supplement all or any of the provisions under these Terms and Conditions.

8) If any dispute arises, our determination shall be final. 

9) Please ensure all your orders have been placed correctly during checkout.

10) For additional add-ons after placement of orders, the following shall be treated as a new order.

PAYMENT METHODS

1) We accept payment by designated credit cards, debit cards or other designated electronic means as specified by us. All product prices listed are in Singapore dollars. 

2) Under Credit Card Purchase Protection service (e.g. Visa Verification Service, MasterCard Secure Code) customers can enjoy safe and secure shopping by using their own credit card with specific password or security code. Credit cards used for shopping should be valid and under the purchaser’s own name.

3) Acceptance of orders is subject to our sole discretion. A final electronic receipt will be issued to you via email and/or our eStore.

4) It is recommended to include the Order No. as Payment Reference during your Paynow transaction. This is to facilitate and speed up the payment verification process. Alternatively, you can also email us a screenshot of the confirmed payment receipt to landscape@sweebee.sg.

E-VOUCHERS AND DISCOUNT CODES

1) We may from time to time offer promotional discount codes which may apply in respect of any or certain specified purchases made through this Website.

2) The conditions of use relating to any discount code will be specified at the time of the issue.

DISCLAIMER

1) By accessing our website, you assume all risks associated with its use, including but not limited to the risk that your computer, software, or data may be damaged by any virus transmitted by this website or by any Third Party Content or Third Party Website.

2) To the extent permitted by law, all warranties, conditions, and claims (whether express or implied) arising out of or in any way connected with this website are hereby excluded.

OUTAGES

1) We reserve the right to cease, interrupt or withdraw your access to the site for any reason, including without limitation, for upgrades and maintenance of the site.

Delivery Policy

DELIVERY LOCATIONS

1) Only local delivery is supported at the moment.

2) It is advisable to indicate the mobile number of recipient(s) so we can liaise directly with them should there be any issue pertaining to the order and delivery. 

3) Delivery service is available to residential and commercial addresses in Singapore except certain restricted areas. We will dispatch the deliveries as scheduled to the best of our ability. 

DELIVERY CHARGES WITHIN SINGAPORE

1) A delivery charge at $15.00 per order per delivery location will be chargeable for all purchases unless self-collect at our nursery. 

2) FREE delivery for purchases above S$300.00.

3) Sometimes part of an order is out of stock and this may delay delivery.

4) Each delivery included single-way transportation to ONE Singapore local address/ destination excluding restricted areas. 

5) Please input remarks upon checkout should there be any restrictions on delivery time and subject to security clearance.

6) Additional delivery fees may be charged for subsequent delivery (deliveries) due to unsuccessful delivery attempts during the first delivery appointment or you give us inaccurate information on your address.

DELIVERY TIMING

Your order will be processed within 2-3 working days upon receipt of payment.

You will be notified upon delivery date or self-collection at our earliest convenience, ideally within 2 working days.

It is expected that delivery will take up to 3 more working days to reach you. The actual delivery date will be informed before goods are delivered. However, upon agreeing with a confirmed delivery time, we shall be granted a reasonable extension of the delivery time, should we be in delay due to abnormal traffic conditions, adverse weather conditions, and unforeseen circumstances. (E.g. accident or nature causes).

Delivery Timing : Monday - Saturday 9am - 6pm, excluded public holiday.

Note:

1) All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable.

2) If from time to time any products become out of stock, we reserve the right to offer alternative product(s) of similar value or style or refund with prior notice.

3) All expected delivery dates and time are estimates only. We shall not be liable for any loss or damage incurred or suffered by the customer as a result of any late delivery. 

4) We reserve the right to amend the delivery timings should unforeseen circumstances such as lack of stock from suppliers or scheduling difficulties, unusual traffic conditions and weather arise.

SERVICE CHARGE

1) In the event that the delivery location is not accessible by lift or items that can’t fit in the lift, additional manpower is required for carrying bulky and heavy items. An additional S$30 will be charged to pay to the delivery agent for physical carriage upward/downward to every floor. $20 for subsequent next 2 levels up/down that require manual carriage service.

ADDITIONAL CHARGES FOR OTHER AREAS OF DELIVERY IN SINGAPORE

1) Kindly note that there will be additional delivery charges for the following areas.

2) These surcharges are imposed due to the length of time required to gain security clearance into these areas.

3) The additional amount charge will be added to the Total Shipping Cost during Order Checkout.

4) We reserve the right to reject any Delivery Area that is deemed not suitable or inaccessible.

5) Additional Charges for restricted areas as follow:

• S$70 - Marina Bay Sands, Jurong Island, All Airport Terminals and Cargo Complexes, All Shipyards, Ports and Naval Bases

• S$30 - Sentosa

6) Please input remarks upon checkout should there be any restrictions on delivery time and subject to security clearance. 

PEAK SEASON SURCHARGE

1) Additional charges may be imposed during the festive period as further demand increase for the holiday season

2) Where there are additional surcharges for delivery, such charges will be set out separately for your acknowledgement and confirmation prior to proceeding to payment

RE-DIRECTION OF ORDERS

1) Please note that we will have to impose an additional shipping charge of S$15.00 for each re-direction of an order.

2) Orders cannot be cancelled once the delivery is initiated.

Cancel, Return, Exchange and Refund Policy

1) The recipient shall be responsible to check on the quantity and quality conditions of the item(s) before signing for the delivery. No exchanges or returns will be entertained after the delivery is completed.

2) We do not exchange/refund for cases listed below:

FOR LIVE PLANT PURCHASES:

Please note that photos and images shown on our website are for illustrative purposes. We trust that you as plant lovers understand that plants are unique living things and will not be 100% identical. The colour tones, shape, size and form will vary with every pot of plant. 

• Tears, holes in foliage, broken stems, yellow foliage, or dried and withering flowers are normal. It is not possible to request for a perfect and flawless plant. That is why the plants need your tender loving care to make them flourish. 

• We try our best to mitigate the risk of pest attack on our plants by conducting pest control regularly. However, we seek your understanding that minor pest attacks are common and often it is beyond our control.

• Please contact us within 24 hours upon receipt of your order if you received live plants with insects/pests, we would be happy to guide you on how you can handle it. It would be great to have gardening sprays as part of the general gardening maintenance process. 

3) We do not exchange/refund for cases listed below:

FOR NON-PERISHABLE PURCHASES:

We will always try to make sure that items delivered to you are of a good condition and correct. However, the following types of items can be put up for return and refund request:

Defective item

• Incorrect item from the initial order

• Expired item

• Missing item

4) If you received any of the above items, please contact our customer service within 7 days upon receiving of your order, subjected to the following terms and conditions:

• Items must be in their original resalable condition.

• All packaging of each item must not be defaced in any manner.

• Once a returned request is granted, you will be entitled to receive an exchange or a refund, which will not include the cost of the original postage and packaging. 

• Items purchased as part of a set or multi-item pack, have to be returned as a whole set.

• If you are returning an item from an order that came with a free Gift With Purchase (GWP) and the value of the order falls below the GWP qualifying amount after the return, the redeemed GWP must be returned as well. If the GWP is not returned, you will incur charges based on the market value of the GWP

• The product can be exchanged for another product of equivalent value or more. If the product exchange is of higher value, the customer will have to pay for the price difference. If the product exchange is of lesser value, the balance amount will not be returned.

5) All return requests are to be submitted to us and the requests will be reviewed by Swee Bee Contractor, subjected to approval. 

6) Swee Bee Contractor reserves the right to conduct final inspection of the condition of the products before all returns, refunds, or exchanges of items purchased are processed.

7) The exchange will be subjected to the availability of the product.

8) We cannot take responsibility for items damaged or lost in the return transit. Please return item(s) to our nursery at 176 Seletar West Farmway 6 S(798040)

9) Delivery charges, products on promotion, and discounted items are not returnable nor exchangeable.

10) Cancellation requests must be made 24 hours by email or phone calls before the delivery is initiated.

11) Please be informed that there will be a cancellation fee of S$30.00 for regardless of the Order Total Amount.

12) Thereafter, the refund of payment will be processed within 7 working days* upon cancellation request is confirmed.

13) Title to the product shall remain vested in us until we receive full payment of the price, and title and risk shall pass to the customer upon collection of the product(s) by our delivery team or by the customer.

14) We strongly encourage that payment should be made immediately to avoid delay in processing your order.

15) Order(s) that are not paid 1 day before the selected delivery date will be cancelled automatically without prior notice. 

*Working days are defined as Mondays to Fridays 9 am to 6 pm.
